HC: Developer bound by MOFA agreements, can’t exceed disclosed plans

Bombay High Court rules that a developer cannot construct additional floors beyond what is disclosed in agreements with flat buyers under the Maharashtra Ownership Flats Act. The court upheld an order restraining M/s KM Realty from building a G+16-storey building instead of the originally planned G+7 storied structure. The developer argued that the consent of existing flat buyers was not required, but the court rejected this argument.

Aviation height restrictions can’t be compromised under any circumstances: HC

The Bombay High Court has refused to allow a developer in Mumbai to apply for relaxation from aviation height restrictions for a high-rise building in Chembur village. The court stated that aviation safety standards cannot be compromised. The developer and housing society have been given six months to bring the building within regulatory limits.

Part of roof collapses in Chintels flat, residents asked to evacuate

A portion of the roof collapsed in tower H of Chintels Paradiso apartments in Gurugram, prompting the developer to ask residents in two towers to vacate immediately. Win for homebuyers in Bhiwandi as state raps scamster builder

Over 1,800 home buyers in Bhiwandi, Mumbai, who have been waiting for their properties for 11 years, may finally see progress as the state home department has directed the attachment of the assets of developer Rajesh Patwa, including land parcels, bank accounts, and a car, under the Maharashtra Protection of Interest of Depositors Act. The developer had preyed on buyers by marketing a proposed township without necessary clearances, leading to criminal charges in 2017. Activists are pushing for amendments to ensure swift action against such developers.

Gurugram Chintels may not go down like Noida twin towers

Manual demolition will likely be carried out to raze the five unsafe towers in Chintels Paradiso instead of controlled blasting, according to the developer. A team of demolition consultants visited the society in Sector 109 on Friday to assess the buildings and outline a plan for the manual demolition, using modern machines and deploying labourers. The developer has hired Edifice Engineering, which demolished the Noida twin towers, for the job. The plan for demolition will be submitted to the administration for approval.

HC strikes down BMC condition, allows high-rise in Fort heritage precinct

The Bombay High Court has allowed the construction of a 69.90-meter-high building in the Fort heritage precinct without the mandatory no-objection certificate from the Mumbai Heritage Conservation Committee. The court ruled in favor of the developer, stating that the civic body did not impose the same condition on a neighboring high-rise project. The court directed the BMC to issue all necessary permissions to the developer without the NOC requirement.
