Pune man accused of damage to public property acquitted due to lack of evidence
The judge in his order stated, “In the case, there is no record to show that the accused is contractor of, or representing Tata Communication Limited or Tata Teleservices. The prosecution has utterly failed to prove the role of the accused by adducing or showing that he worked for the companies, or if he is contractor and he is responsible for the damage. There is no documentary evidence.”
NA Patel, judicial magistrate first class (JMFC) on May 4, acquitted Anil Damlu Rajput, who was accused in connection with a case lodged against him under the Prevention Of Damage To Public Property Act, 1984 with the Chatushrungi police in 2011.

Abhijit Deshpande, site engineer, Pune Municipal Corporation (PMC), was intimated that damage was caused to the road between IDBI road and Pan Card Club road by Tata Communication and Tata Teleservices in order to lay cables. The work was carried out on February 13, 2011, without the permission of the PMC. Deshpande lodged a complaint against the companies alleging damage to property and Rajput was made an accused in the case.
A case various Sections of the Indian Penal Code (IPC) and Section 3 of the Prevention Of Damage To Public Property Act, 1984 was lodged against Rajput.
