Oshiwara building alterations: Police to send notices to Kapil Sharma, Irfan Khan

A police officer said BMC can demolish the alleged alterations if it comes to the fore that the original floor plan was tampered with by the accused

The police plan to issue notices to actors Kapil Sharma, Irrfan Khan and four others, including the developer, to record their statements, as part of the investigation into the Brihanmumbai Municipal Corporation’s claims of illegal alterations in in Dev Land Housing (DLH) Enclave residential tower in Oshiwara.

Abhay Dinkar Jagtap, 39, a sub-engineer with the P /South ward of BMC, lodged a first information report (FIR) against the accused under section 53(7) of the Maharashtra Regional Town Planning (MRTP) Act.

Sharma has not visited his home in the past three days, said an official from Oshiwara police station.A police team tried to get in touch with him through his secretary and also visited his office.

“We could not find Sharma at his residence. We will issue separate notices to all accused asking them to record their detailed statements with us,” said Subhash Khanvilkar, senior inspector, Oshiwara police station.

The Oshiwara police plan to get the original documents pertaining to DLH Enclave tower. So far, six FIRs have been registered against the two actors and four more residents including the developer.

“We will ask the BMC officials to give the evidence -- the original plan and details of the violations committed by the accused,” said Khanvilkar. “FIRs are registered to ensure no more alterations are carried out. In this case, we are told they have already made the alterations. The BMC can carry out demolition after following the due procedure,” said a police officer.

The officials are now getting details of Sharma’s other homes in the city, so a notice can be served to him. According the Oshiwara police, there is no need to rush with the arrest, as MRTP Act, under which the accused has been booked, is classified as minor in the Supreme Court’s guidelines.
