DTCP orders FIR against Mahira developers for submitting forged building plan

The buyers alleged that despite directions, the developer has been insisting on cancelling the allotments

The department of town and country planning (DTCP) has ordered that a criminal case be registered against realtors Mahira Home Private Limited for submitting forged building plans for a project in Sector 88B in the city.

TL Satyaprakash, director general, town and country planning department, also directed that no fresh licence or permission be granted to projects being executed by Mahira Developers, including its sister concerns and directors.

The order issued by TL Satyaprakash on Tuesday said,”I hereby order not to process any licence application or approvals of Mahira Homes Pvt. Ltd. and its subsidiary/associate companies and its directors, who have not improved their practices of submitting the forged documents to the department. I also order to lodge an FIR against the colonizer i.e. Mahira Homes Pvt. Ltd., its directors, associate companies, authorized signatory and the Architect, who submitted the forged plans in GMDA in respect of license no. 09 of 2022 ( 6.675 acres) and additional license no. 61 of 2023 (3.40 acres), without approval of the same by this department.”

According to the details shared by the department, the DTCP granted a licence to Mahira Developers to construct a residential society, Mahira Homes, on 6.675 acres in Sector 88B under the affordable housing policy (Garhi Harsaru) on Gurgaon-Pataudi Road.

Its building plan was approved on May 10 last year. The department said the developer took an additional licence this year to developer 3.40 acres, increasing the existing licensed area of the society. The building plan for the additional land licence was placed in the meeting of the building plan approval committee (BPAC) held on April 11, which has not been approved yet, the department said.

DTCP officials said the developer prepared fake building plans of 10.075 (6.675+3.40) acres and submitted them to the Gurugram Metropolitan Development Authority (GMDA) for approval of the service plan estimate.

The signatures of BPAC members were forged on the building plans, the DTCP said. The forgery came to fore when the chief engineer of GMDA approved the service plan estimate and sent it to the DTCP headquarters, said officials.

“The above act of the colonizer is purely a case of cheating and fraud and purely a breach of trust with the department. The colonizer has earlier done similar practices by submitting forged bank guarantees in other licenses i.e. license no. 128 of 2019, 24 of 2020, 106 of 2017 and 61 of 2021 and resultantly was blacklisted by the department. However, the colonizer has neither improved his conduct nor stopped doing wrong practices,” the order by Satyaprakash said.

Sikander Chokkar, managing director, Mahira Developers, did not respond to calls and messages seeking a response.

Another senior official of Mahira Developers was also contacted for comment, but there was no response.

In a related development on Wednesday, a large number of buyers of Mahira Homes project in Sector 104 carried out a protest outside the office of Haryana Real Estate Regulatory Authority (H-Rera) in Gurugram, alleging that work had stopped at the project site, despite the buyers having paid 125 crore to the builder for their flats.

The buyers alleged that despite directions by authorities, the developer has been insisting on cancelling the allotments of flats to buyers.

There are around 1,483 affordable units in the project at Sector 104 and almost all units have been sold out, and the developer has collected more than 125 crore from the allottees, but presently, no construction work is being carried out at the site, the buyers said.

Kamal Bhardwaj, president of the buyers association, said the developer has already collected 25% of the total cost from them and is still not carrying out work. “We also want H-Rera to issue an order at the earliest to resolve our woes,” he said.
